Terms of service

These Terms of Service ("Terms") apply to your use of the A&O American online store and website, including every page, product, feature and service we offer (the "Services"). In these Terms, "A&O American," "we," "us" and "our" refer to A&O American, and "you" refers to anyone who visits the site or buys from us.

By using the Services or placing an order, you agree to these Terms, along with our shipping policy, refund policy and privacy policy, which are part of these Terms. If you don't agree, please don't use the Services.

1. Using our store

You must be at least 18 years old, or the age of majority where you live, to place an order, or have the permission and supervision of a parent or guardian. You agree to give accurate, current information when you check out and to keep your account details secure.

You agree not to use the Services for any unlawful purpose, and not to use bots, scripts or other automated tools to access the site, monitor inventory or place orders.

2. Products and descriptions

We work to describe and photograph every product accurately, including condition, set, language and other details. Colors and appearance can vary slightly between photos and the actual item depending on your screen. Please read each product description carefully before you buy.

Graded cards. Grades and certifications are issued by independent third-party grading companies. We don't grade cards ourselves and can't guarantee that a card would receive the same grade if it were resubmitted.

Blind boxes. Blind boxes contain random items. We can't guarantee which item, character or variant you'll receive, or that you won't receive duplicates.

Sealed product. We sell sealed product as received from manufacturers and distributors. We can't guarantee the contents, pull rates or card values of any sealed product.

3. Trademarks and affiliation

Pokémon, One Piece, Magic: The Gathering, Yu-Gi-Oh!, Riftbound, Dragon Ball Super, Naruto and all other game names, logos, characters and card images belong to their respective owners. A&O American is an independent retailer and is not affiliated with, sponsored by or endorsed by any of these companies unless we say so.

4. Pricing, availability and orders

All prices are in US dollars and can change without notice. Products are available while supplies last. Receiving an order confirmation doesn't mean we've accepted your order; we accept an order when it ships.

We reserve the right to limit the quantity of any product per person, household, account, payment method or shipping address. We may refuse or cancel any order, including orders that exceed purchase limits, appear to be fraudulent, appear to be placed for resale or by automated tools, or contain a pricing, description or inventory error. If we cancel an order after you've paid, we'll refund the canceled items in full.

5. Pre-orders

Release dates for pre-order items are estimates set by manufacturers and distributors and can change. You can cancel a pre-order for a full refund at any time before it ships by contacting us. Once a pre-order ships, it's covered by our refund policy like any other purchase.

If a manufacturer cancels a release or reduces our allocation, we may cancel some or all affected pre-orders. We'll refund any canceled items in full.

6. Custom orders

For custom items such as laser engraved products and custom 3D prints, you're responsible for reviewing and approving the final design, including spelling, text, layout and colors. Once you approve a design, the order is final as described in our refund policy.

By submitting text, images, logos or designs for a custom order, you confirm that you have the right to use them. We may decline any custom request, including requests that we believe infringe someone else's rights or are offensive or unlawful.

7. Payment

Payments are processed securely through our checkout. By placing an order, you confirm that you're authorized to use the payment method you provide. You're responsible for any applicable taxes, which are calculated at checkout.

8. Shipping, returns and refunds

Shipping is covered by our shipping policy, and returns and refunds are covered by our refund policy.

9. Our content

The design, text, graphics, photos and other content we create for the Services belong to A&O American or our licensors. You may not copy, reproduce or reuse our content for commercial purposes without our written permission.

10. Third-party services and links

The Services may include links to, or use services from, third parties such as payment processors, shipping carriers and social media platforms. We aren't responsible for third-party websites or services, and your use of them is subject to their own terms.

11. Disclaimer

Except as expressly stated in these Terms or required by law, the Services and all products are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the site will always be available or free of errors.

12. Limitation of liability

To the fullest extent permitted by law, A&O American and its owners, employees and suppliers won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data, arising from your use of the Services or any product. Our total liability for any claim related to an order is limited to the amount you paid for that order.

Some states don't allow certain limitations of liability, so some of these limits may not apply to you.

13. Indemnification

You agree to defend and hold harmless A&O American and its owners and employees from any claims, damages or expenses, including reasonable attorneys' fees, that arise from your breach of these Terms or your misuse of the Services.

14. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law rules.

If you have a concern, please contact us first so we can try to resolve it. If we can't resolve it within 30 days, either of us may bring a claim in the state or federal courts located in Denton County, Texas, and you and we agree to those courts' jurisdiction. Either of us may also bring an individual claim in small claims court if it qualifies.

15. Changes to these Terms

We may update these Terms from time to time. Changes take effect when they're posted on this page, and the date at the top shows when they were last updated. Orders placed before a change are governed by the Terms in effect when the order was placed.

16. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms isn't a waiver of our right to do so later. These Terms, together with the policies referenced above, are the entire agreement between you and A&O American regarding the Services.
